Agreeing to these terms
These terms apply when you download, install or play the LAX JAM game on any device (the "Game") and when you use the website at playlaxjam.com (the "Site"). In these terms "LAX JAM", "we", "us" and "our" mean the developer and publisher of the Game and operator of the Site; "you" means you.
By playing the Game or using the Site you agree to these terms and to our Privacy Policy. If you don't agree, please don't use them. If you're under the age of majority where you live, a parent or guardian needs to agree for you.
Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game for your own non-commercial entertainment, on devices you own or control, as allowed by the store you got it from. Streaming and sharing clips, screenshots and videos of your games is welcome, including on monetized channels.
You may not: copy, sell, rent, lend or redistribute the Game; reverse-engineer, decompile or modify it, except where the law allows this despite this restriction; extract or reuse its art, audio, code or other assets outside the Game; remove notices from it; or use it to build a competing product.
Apple and the App Store
If you get the Game from Apple's App Store, your licence is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"). Where the Standard EULA and these terms conflict, the Standard EULA wins for the App Store version. You and we also agree that:
- These terms are between you and us, not Apple, and we, not Apple, are responsible for the Game and its content.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to meet any warranty that applies, you may tell Apple and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the Game.
- We, not Apple, are responsible for any claims about the Game, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If anyone claims that the Game or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Purchases and refunds
Prices, payment and refunds for the Game and anything bought in it are handled by the store you bought from. For App Store purchases, you can ask Apple for a refund at reportaproblem.apple.com. Nothing in these terms takes away any right to a refund you have under consumer law.
Fair play
Don't use cheats, exploits, bots or modified versions of the Game to gain an advantage, and don't interfere with the Game, the Site or anyone else's enjoyment of them. If the Game later includes online play, leaderboards or player names, don't use them to harass anyone or to post anything unlawful, hateful or offensive. We may reset records, remove content or restrict access if you break these rules.
Our content
The Game and the Site, including the LAX JAM name and wordmark, characters, sprites, stadiums, music, sound effects, announcer recordings, text and code, belong to us or our licensors and are protected by copyright, trademark and other laws. Other than the licence above, we don't give you any rights in them.
If you send us ideas or feedback, you let us use them freely, without owing you anything.
Leagues, teams and nations
LAX JAM is an independent arcade game. It is not affiliated with, sponsored by or endorsed by World Lacrosse, the Premier Lacrosse League, any national governing body, national team or athlete. Country names, colours and emblems in the Game identify the nations represented; the kits and crests are our own designs. The players in the Game are fictional.
Betas and changes to the Game
Pre-release versions (for example through TestFlight) may be unfinished, contain bugs and lose saved progress. Please keep what you see in a beta confidential until it's public, unless we say otherwise.
We may update the Game to add, change or remove features, fix problems or meet legal requirements. Some updates may be needed to keep playing.
The website and email list
The Site is for your personal, non-commercial use. Don't try to break, overload, scrape or get around its security. When you join the launch email list, you agree to receive emails about LAX JAM, and you can unsubscribe at any time. See the Privacy Policy for how we handle your email address.
Disclaimers
We work hard on the Game and the Site, but they are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise they will be uninterrupted or error-free. Some places don't allow these exclusions, so some of them may not apply to you.
Arcade lacrosse on a screen is not a substitute for real sport: please take breaks, and don't try the Air Gait at home.
Limits on liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Game or the Site. Our total liability for any claim related to them is limited to the greater of the amount you paid for the Game in the 12 months before the claim or US$50.
Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing affects the statutory rights you have as a consumer where you live.
Ending these terms
You can stop using the Game and the Site at any time by deleting the Game and leaving the Site. We may suspend or end your licence if you seriously or repeatedly break these terms. The sections on our content, disclaimers, limits on liability and general terms continue after these terms end.
General
We may update these terms. If a change is significant, we'll let you know in the Game, on the Site or by email before it takes effect; continuing to play after that means you accept the new terms. If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to do so later. You may not transfer your rights under these terms; we may transfer ours as part of a sale or reorganization of the LAX JAM business. These terms and the Privacy Policy are the whole agreement between you and us about the Game and the Site.
